These terms apply when you use mistelle.store or buy from Mistelle ("we", "us", "our"). By using our site or placing an order, you agree to these terms. Please read them together with our Refund Policy, Shipping Policy and Privacy Policy.

1. Using our store

You must be at least 18 years old to place an order, or have permission from a parent or guardian. You agree to give us accurate information and not to use the site for any unlawful purpose or in a way that could damage it or interfere with other users.

2. Products and descriptions

We try to describe and show our products as accurately as possible. Some images are styled or illustrative, and colours may look slightly different on your screen. If a product you receive doesn't match its description, please see our Refund Policy.

3. Health and safety

The Mistelle Eye Mist Massager is a personal wellness device. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

• Read and follow the instructions included with the product.
• Don't use the device if you have an eye condition, eye injury or infection, or have recently had eye surgery, unless your healthcare professional says it is safe.
• Remove contact lenses before use.
• Stop using the device if you feel pain or discomfort, and seek medical advice if needed.
• The device is not intended for children.

4. Prices and payment

All prices are in Australian dollars (AUD) and include GST where applicable. We may change prices at any time, but changes won't affect orders we have already confirmed. Payment is taken when you place your order and is processed securely through our checkout. We do not store your full card details.

5. Orders

Your order is an offer to buy. A contract forms when we send you a shipping confirmation. We may refuse or cancel an order, for example if a product is out of stock, a pricing error has occurred or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.

6. Shipping and delivery

We currently ship within Australia only. Standard shipping is free, and Express shipping is available at checkout for a fee shown before you pay. Delivery times are estimates and may be affected by carriers or events outside our control. Responsibility for the goods passes to you when they are delivered to the address you gave us. 7. Returns and refunds

Returns and refunds are covered by our Refund Policy. Nothing in these terms limits your rights under the Australian Consumer Law.

8. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9. Limitation of liability

To the extent permitted by law, and apart from your rights under the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of our site or products. Where the law allows us to limit our liability, it is limited to replacing or repairing the goods, or refunding what you paid for them.

10. Intellectual property

All content on this site belongs to Mistelle or its licensors, including text, images, logos and design. You may not copy, reproduce or use it for commercial purposes without our written permission.

11. Reviews and feedback

If you send us reviews, comments or feedback, you allow us to use them to promote and improve our products. You agree that anything you submit is honest and lawful, and doesn't infringe anyone else's rights.

12. Third-party links

Our site may link to other websites. We are not responsible for their content or practices.

13. Changes to these terms

We may update these terms from time to time. The version on this page when you place an order is the version that applies to that order.

14. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we agree to the jurisdiction of the courts of New South Wales.
